In March 1997, Bill Gordon Powell filed an action in the District Court for the Fourth Judicial District in Missoula County against the Salvation Army. Powell brought suit pursuant to Â§ 49-2-303, MCA, and the Americans with Disabilities Act, 42 U.S.C. Â§ 12010 to 12213 alleging the Salvation Army unlawfully discriminated against him by terminating his employment on the basis of Powells past history of alcoholism. The Salvation Army subsequently filed a motion to dismiss, which the District Court granted on July 1, 1997. It is from the courts order dismissing his complaint that Powell presently appeals. For the reasons stated below, we reverse.
